Children and Marriage

The Most Important Thing You Can Do For Your Child Is Have A Good Marriage!

You can use most any measure. when you're speaking of 'Success'. You can measure it in fancy homes, Expensive cars or dress., but....the measure of your REAL success is the one you can not spend. It's the way your kids describe YOU when they're speaking to a friend! - Martin Buxbaum

Now you might be thinking, "Why is he writing this? Isn't this the MARRIAGE guy?"

Don't worry; you're not losing your mind. I am the marriage guy.This IS about your MARRIAGE! Let me explain.

You're probably trying your best to be a good parent, right? Think for a moment about all the time, energy, and money you put into your children. You send them to the best schools, help them with their homework, buy them the cutest Sunday clothes, work hard to save for their college education, take them to the best doctors, plan special birthday parties, drive them to baseball practice, and make their favorite dinner.

That's all fine, but make no mistake about it; the MOST IMPORTANT thing you can do for your children is NONE of those things. The most important thing you can do for your children has nothing to do with their education, entertainment, athletic endeavors, or even their physical health. The most important thing YOU can do for your children is to have a GREAT MARRIAGE with your spouse.

It's hard to be a good parent unless you have a good marriage. Why? Because teaching your children how to succeed in love is your MOST IMPORTANT responsibility.

There will be nothing more important in your children's lives than the success of their marriage. (I know you know that.) And who's going to teach them how to love their spouse. You are! But they won't learn it from what you say; they'll learn it from the life you lead...they'll learn it from YOUR marriage.

Ralph Waldo Emerson said, "Who you are speaks so loudly, I can't hear a word you're saying."

Whatever you want your children to achieve in their life, you first have to achieve yourself. If you're struggling in your marriage, it's probably because your parents struggled too. So, who's going to break the cycle? Will YOU be the one to change things for generations to come? Or will your children suffer the same burden? The ball’s in your court.

It's not easy to be what's called a "transition person." but it's doable. YOU can be the "transition person" in your lineage and pave a new path for future generations in your family.

There's nothing better for your children than to be raised amidst the comfort of parents who love each other. And there's nothing more devastating to a young soul than to be the victim of a broken family.

If your children don't see love between you and your spouse, it won't matter where they go to school or how fashionably they dress. But if they witness true love between you and your spouse, you will give them the greatest gift life has to offer.

Be a good parent. Do everything you can to succeed with your marriage.

TIPS TO APPLYING FOR UNEMPLOYMENT

August 30, 2010

Applying for Unemployment: The Magic Words to Use

By Aaron Crowe, Posted Aug 27th 2010 @ 6:00AM

Text Size A A A

Filing for unemployment benefits can be tricky. If you're lucky and haven't lost your job before, it can be a difficult process to wade through the red tape. Some states, such as California, at least try to make it easy with various ways to file.

But there's one area of the claim form that you don't want to mess up when filing, even though your head is probably still spinning from losing your job -- the reason for losing your job. You want to tell the truth, and there are some "magic words," or keywords, to use so that an unemployment benefits claim isn't quickly rejected.

Remember that each state sets its own laws on such things, so these suggested terms may not work everywhere.

"Laid off."

If you lost your job through no fault of your own because the company is downsizing, then this is the term to use. Even if you accepted a buyout so that you wouldn't be laid off, it's still technically a layoff and you're entitled to unemployment benefits.

"Job eliminated."

This is basically the same as a layoff, and puts the burden of proof on the employer. Go with what you were told by your employer when you lost your job, said Jill Pugh, an employment law attorney in Seattle.

If you were fired but tell the unemployment department that you were laid off, you could be accused of fraud, which could result in penalties beyond paying back any unemployment benefits you've collected, Pugh said. Penalties could include being disqualified for future benefits the next time you apply, to a higher interest rate when paying back owed benefits.

"Restructuring."

This again shows that the job loss was out of your control and that the company chose to let you go as it restructured its workforce. Saying that you got a buyout may not be the best way to word it, because some states consider that leaving your job at your choice, although most states allow workers who accept buyouts to collect unemployment if they were in fact laid off.

The ultimate test, Pugh said, is that a worker lost their job through no fault of their own. If so, they should get benefits. Employees can be fired and still collect benefits if they couldn't do the job and it wasn't their fault, Pugh said. Being unable to work a computer program, for example, could lead to being fired. But because the employee didn't do it willfully, they can still get benefits.

"Position terminated."

This puts the emphasis on the job itself instead of the person who lost their job.

"Let go because..."

This term replaces using "quit," which should be avoided, Pugh said. Using "quit" implies it was your choice. If you had good reason to quit, then you can collect unemployment. Good causes include taking a big pay cut of 25 percent, unsafe workplace, illegal behavior by others at work, sexual harassment at work, and failure to accommodate workers with disabilities. But you must have complained about the cause long before quitting

"Discharged."

This is OK to use, Pugh says, if you were fired for something that you didn't do wrong, such as steal from the company.

In California, if a claimant is discharged for misconduct connected with work, benefits may be denied, said Pasadena lawyer Melanie Calvert, in an e-mail to AOL Jobs. "Misconduct means gross misconduct which harms the employer's business. Ordinary negligence is not generally considered gross misconduct. If a California claimant was discharged or quit due to an 'irresistible' compulsion to use intoxicants, he or she may be denied benefits. On the other hand, a claimant may receive benefits if they quit due to unlawful job harassment."

"Fired."

It's a difficult word to put on an unemployment application and one you want to avoid if possible, but it shouldn't stop you if you did nothing wrong. One huge trick of employers is to ask an employee to resign or be fired, with the implication that they'll still get benefits if they resign but won't if they're technically fired, Pugh said. Misconduct by the employee won't lead to unemployment benefits, so there's no sense in fighting it, but if you did nothing wrong, then you can still get fired and claim benefits.

"I wouldn't fall for it," she said of employers trying to entice people to quit. "It's much, much harder to get benefits if you quit than if you were discharged."

That's because the burden of proof for getting benefits is on the worker if they quit, and on the employer if discharged.

"I quit in lieu of termination."

That's the phrase to keep in mind when applying for benefits if you quit while being threatened with termination, Pugh said. Even if the firing is justified, it could still be based on nothing bad on the employee's part. For example, if you violated a company rule you didn't know about, it wasn't an intentional bad act and you should still be able to collect benefits.

People worry about the stigma of getting fired and what it will look like to future employers. But if you didn't do anything wrong, it's nothing to hide from. Only your employer who fired you can look at your unemployment claim, and potential employers are not allowed to look at it, Pugh said.

"A lot of times people don't want to do that because it looks bad," she said of admitting being fired on an unemployment application.

Applying for unemployment benefits is a right to people who have lost their jobs, and it can be a stigma for people who have never done it before. The good news is that the national recipiency rate -- the percentage of unemployed workers who collect benefits -- is dropping, from 45 percent in 2001 to 37 percent in 2008. That's more people claiming the benefits they're entitled to -- as long as a few words don't trip them up.

DEALING WITH TRAFFIC TICKETS

August 3, 2010

You've probably read articles about fighting traffic tickets -- but the reality is many of us (probably most of us) just don't have the money to hire a lawyer -- or the time/expertise (let alone gumption) to actually challenge a ticket on our own. There are some alternatives,  however.

Plead Guilty -- With Explanation

Sometimes you can get a reduced charge by pleading guilty -- but with an explanation. Provided you have an otherwise clean record -- and the charge itself is relatively minor -- often, this can yield good results.

Remember -- what they want most is money. The charge itself is of secondary importance.

A great deal depends on the judge, however. Some are hard cases, others more reasonable. Before you decide to go this route, it's smart to get to court early and watch how your judge handles other cases -- especially those similar to your own. If you think, based on his actions, that he's going to throw the book at you -- you can always request a continuance; in many states, these are granted automatically upon request. Simply tell the judge you are not ready to go to trial. A continuance will push your court date off for another few weeks or so and give you time to prepare a defense -- or hire a lawyer.

Bargain

Traffic courts are a lot like buying a new car -- because there's lots of haggling involved. You can ask the judge (or the prosecuting/commonwealth's attorney) about the possibility of agreeing to attend driving school and/or pay a fine in return for dropping the charge against you -- or changing the charge to a non-moving violation, which avoids DMV "points" being assigned to your driving record. That means your insurance company won't have a pretext for a rate hike. In some counties/states, certain charges aren't reported to the DMV at all -- especially if it's an out-of-state ticket. (Mostly, these include non-moving violations such as "defective equipment" -- a common "lesser charge" that's often assigned in lieu of the original moving violation.)

The key thing, however, is to avoid the moving violation conviction -- even if it means paying a larger fine than you'd otherwise have paid for just the ticket/offense you were originally charged with. A one-time hit to your wallet is infinitely preferable to having that ticket held against you for anywhere from three to five years -- the length of time it will be on your DMV record -- and used by your insurance company to justify higher premiums. The total cost of a single moving violation on your DMV record can easily exceed the one-time hit of a fine for "defective equipment" (or whatever) many times over. And keep in mind: If you should be unlucky enough to receive another ticket before the old one "drops off" -- your jeopardy has just doubled. The points stack up -- and your insurance goes through the roof. How likely is it you can go for another five years without getting nailed again? For many of us, that's a virtual impossibility!

It's possible in some states to take the DMV-authorized "driving school" online -- and avoid the hassle of spending an entire Saturday reliving high school detention. See http://www.trafficschoolonline.com  for more information.

Bottom Line

Either of these alternatives -- pleading guilty with an explanation or bargaining your way to a lesser charge -- can be more cost-effective than hiring a lawyer or spending days/weeks of your own time doing what's necessary to fight the ticket yourself. Most of us have jobs and responsibilities that make that very difficult, if not impossible. And it can be very intimidating for a layman to go up against the system, subpoenaing records, questioning the ticketing officer in open court -- and so on. By challenging the system in this way, one also runs the very real risk of antagonizing the court -- and becoming the target of an angry judge looking to "teach someone a lesson." It's true you can always appeal a conviction (in many states, a traffic law case may even entitle you to a jury trial, if you want to take it that far). But that involves yet more time, yet more expense. How much of either can you afford to spend on a traffic ticket beef?

Yes, there's the principle involved. If it's a really unjust ticket, you may be motivated to go all the way -- and do whatever it takes to beat the rap. But sometimes, it's smart to pick your battles -- and go for the best outcome you can realistically hope for given time and other constraints.

US GUN LAWS

Who Cannot Have a Gun in America?

Guide Extra:

The Gun Control Act of 1968 prohibits certain people from possessing a firearm. The possession of any firearm by one of these "prohibited persons" is a felony offense. It is also a felony for any person, including a registered Federal Firearms Licensee to sell or otherwise transfer any firearm to a person knowing or having "reasonable cause" to believe that the person receiving the firearm is prohibited from firearm possession. There are nine categories of persons prohibited from possessing firearms under the Gun Control Act:

  • Persons under indictment for, or convicted of, any crime punishable by imprisonment for a term exceeding on year;
  • Fugitives from justice;
  • Persons who are unlawful users of, or addicted to, any controlled substance;
  • Persons who have been declared by a court as mental defectives or have been committed to a mental institution;
  • Illegal aliens, or aliens who were admitted to the United States under a nonimmigrant visa;
  • Persons who have been dishonorably discharged from the Armed Forces;
  • Persons who have renounced their United States citizenship;
  • Persons subject to certain types of restraining orders; and
  • Persons who have been convicted of a misdemeanor crime of domestic violence.

With limited exceptions, persons under eighteen years of age are prohibited from possessing handguns.

The New Science of Sensational Sex

Print

better sex tips

Researchers are unveiling breakthroughs that truly work for grown-up women (we promise: not a stiletto or silly gadget among them).

Courtesy of Prevention

A fulfilling sex life is one of the most important ways to stay connected to your partner and boost self-esteem. But great sex doesn't just happen on its own--and less so as you age. Your need for intimacy changes, and your body may not respond the same way it did when you were younger. Here, five common reasons that women over 40 find their libido lagging, and the scientific interventions that can get it happily humming along again.

Help Reaching Orgasm
Libido Enhancing Drugs

Reason: You Have Low Testosterone
We tend to think of testosterone as a "male" hormone. But small amounts--delicately balanced with estrogen--fuel a woman's sex drive. Unfortunately, at menopause testosterone starts to decline, which can cause desire to plummet. Hormone therapy throws off the balance even more. A blood test and your gynecologist can determine if low testosterone is to blame. Luckily, studies show that stabilizing testosterone levels can rev up arousal in postmenopausal women--and improve all areas of sexual response, from lubrication to stronger, more powerful orgasms.

How Science Can Help
Testosterone gel
Although the FDA has not yet approved a testosterone gel specifically for women, many doctors simply prescribe the male version off-label or have a compound created by a pharmacist (a female gel is in the works--see "2 Libido-Enhancing Drugs" below). And no, it won't make you grow hair on your chin or give you huge muscles. "The doses prescribed for women aren't large enough to stimulate male characteristics," says Anita Clayton, MD, clinical professor of obstetrics and gynecology at the University of Virginia and author of Satisfaction: Women, Sex, and the Quest for Intimacy.

Libido-boosting herbs
Certified sex researcher Beverly Whipple, PhD, professor emerita at Rutgers University and coauthor of The Science of Orgasm, recommends ArginMax for Women, a nutritional supplement containing ginseng, ginkgo, multivitamins, and minerals. Science backs her up. ArginMax increased sexual desire, including clitoral sensation and orgasm frequency, in several studies. In one, women taking the supplement daily for 4 weeks reported a 74% improvement in satisfaction with their sex lives. In another study, men taking the male version of ArginMax experienced similar results.

Birth control with benefits
"Ironically, oral contraceptives increase levels of a protein that binds with testosterone and makes it less available to get our brains thinking about sex," says Clayton. But hormonal contraceptives that are inserted into the vagina and release a minimal amount of localized hormone (such as the NuvaRing), or are administered through the skin (such as a patch) and nonhormonal methods (such as condoms or spermicides) can free up that testosterone--and your sexual desire

Surprising Effect of Sex on the Brain

-- From the Editors at Netscape Sex makes the brain grow. At least, it works that way in rats.

When we experience stress or anxiety, it can stifle brain growth, previous research has shown. So does the opposite hold true? Would pleasant experiences help brain cells to grow? Princeton University researchers wanted to know, so they studied the effect of sex on laboratory rats.

The study: LiveScience.com reports that the researchers gave adult male rats access to sexually-receptive females either once a day for two weeks or just one time in two weeks. In addition, they measured the blood levels of each rat for stress hormones called glucocorticoids, which the Princeton team thinks cause the detrimental effects that unpleasant or stressful experiences have on the brain.

Study Shows that Sex Boost the Brain!

TIPS TO APPLYING FOR UNEMPLOYMENT

  • Persons under indictment for, or convicted of, any crime punishable by imprisonment for a term exceeding on year;
  • Fugitives from justice;
  • Persons who are unlawful users of, or addicted to, any controlled substance;
  • Persons who have been declared by a court as mental defectives or have been committed to a mental institution;
  • Illegal aliens, or aliens who were admitted to the United States under a nonimmigrant visa;
  • Persons who have been dishonorably discharged from the Armed Forces;
  • Persons who have renounced their United States citizenship;
